Consent for Telemedicine Services

By using the telemedicine services provided by Kerbside Health, Inc. ("Kerbside Health," "we," "our," or "us"), you acknowledge and agree to the following terms.
Disclaimer: The information and services provided by Kerbside Health are for educational and informational purposes only. They do not constitute medical advice, diagnosis, or treatment, and are not intended to substitute for professional medical judgment.
1. Nature of Telemedicine Services
1.1 Our telemedicine services involve the use of secure electronic communications to provide virtual second opinions for informational and educational purposes only.
1.2 Our services do not include diagnosis, treatment, prescription, or the establishment of a physician-patient relationship.
1.3 Consulting providers are independent contractors, not employees or agents of Kerbside Health.
1.4 No State Licensure Requirement: Kerbside’s consulting providers are licensed physicians in their own states. Because our service consists solely of educational second opinions (no diagnosis, treatment, or prescriptions), providers are not required to hold medical licenses in every U.S. state from which patients may access our platform.
1.5 This service is not intended to comply with the diagnostic, treatment, or telehealth requirements of any specific state or country. By using this platform, you acknowledge that the services are rendered exclusively as non-clinical educational consultations.
1.6 By using Kerbside Health’s services, you consent to the storage and use of your submitted medical records, images, and communications for the purposes of delivering the second opinion service and improving platform quality, in accordance with our Notice of Privacy Practices.
2. Risks and Benefits
- Potential benefits include improved access to specialty expertise, convenience, and cost-effectiveness.
- Potential risks include interruptions due to technical failures, unauthorized access despite security measures, and limitations of a non-physical evaluation.
3. No Emergency Services
3.1 Telemedicine services are not intended for medical emergencies. If you are experiencing an emergency, call 911 or seek immediate medical attention.
4. No Physician-Patient Relationship
4.1 You understand and agree that no physician-patient relationship is created between you and Kerbside Health or any consulting provider.
4.2 The second opinions provided are for informational purposes only and do not replace consultation, diagnosis, or treatment from your local healthcare providers.
4.3 These services have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, or prevent any disease.
5. Your Responsibilities
- Provide accurate and complete information when requested.
- Consult your personal physician before making any healthcare decisions based on the second opinion.
- Do not disregard or delay seeking in-person medical care based on information from Kerbside Health.
6. Privacy and Security
6.1 We use HIPAA-compliant platforms to protect your health information.
6.2 Your information is handled according to our Notice of Privacy Practices.
7. Consent
